Quick, post-holiday blog about the #environmentaljustice case Impact Louisiana v. St. James Parish, which was dismissed this month for (mostly) statute of limitations issues. Three big takeaways - first, statute of limitations are hard to get around; second, how the legal system works makes it hard to get at perceived roots of EJ issues; and third, three different sets of people (lawyers, scientists, advocates) seem to be pretty frequently talking past each other about what's going on with EJ. We wrote about this case in March when it was filed (don't worry, I won't hold it against you if you've forgotten.) It's a fascinating case where lawyers tried to use core civil rights statutes to get at health issues more typically thought of as needing to be addressed with core #environmentallaw statutes. This was (perhaps predictably) unsuccessful. Check it out.
